At SafeTracks GPS Canada Inc., we believe in building relationships with our customers. These relationships are built on trust and respect and we believe that is the way a business should be operated. Part of establishing trust and respect is done by telling you what information we will require from you, how this information will be handled, and how this information will be kept safe. We know that your personal information is a valued asset and we want you to know that we will treat it that way.

General

This privacy statement (“Policy”) describes the current policies of SafeTracks GPS Canada Inc. (“SafeTracks” or “we” or “our”) with regard to personal information collected by us from you. Your privacy is important to SafeTracks. Please read through this Policy to familiarize yourself with our privacy practices. Overview

We recognize the importance of an individual’s right to protect personally identifiable information and this Policy sets out the privacy policies and practices for SafeTracks with respect to how SafeTracks may collect personal information. It also describes how SafeTracks maintains, uses, and discloses personal information.

This Policy applies to information collected by SafeTracks through this website, apps and/or any of its subdomains (collectively, the "Sites"), as well as other places where we may collect personal information. This Policy also sets out how you can access certain information that SafeTracks may collect about you. In this Policy, "personal information" means information is information that identifies you as an individual or opinions about an individual whose identity is apparent or can be reasonably ascertained from the information or opinions. When you create an account on our website, register your products, download a file or map, order product or service on our website, sign up for a newsletter, participate in promotional activities, or contact our product support personnel, we may collect a variety of Personal Information, which depending on the circumstances may include your name, mailing address, phone number, email address, and payment card information (“Using the Website”). We may use Personal Information about you for the following purposes:

By Using the Website, you agree to the terms and conditions of this Policy. SafeTracks reserves the right, in its discretion, to change, modify, add or remove portions of this Policy at any time and from time to time, without prior notice to you. If our Policy changes in the future, we will notify you of any such changes by posting an updated policy on our website. Following the posting of such changes, your continued use of the www.safetracksgps.ca website will constitute your acceptance of these changes and you will be bound by such changes. If you do not continue to use the www.safetracksgps.ca website following a change to our Policy but take no other action with respect to your personal information, our use of that information will remain subject to our Policy as it was in effect prior to the change. You are responsible for regularly reviewing this Policy and any changes thereto.

The Sites may contain links or allow you to link to third party websites that are not related to, controlled by or operated by SafeTracks. Please understand that this Policy does not apply to such third party websites, and SafeTracks is not responsible for the content of such third party websites or the privacy practices of such third parties. Therefore, SafeTracks encourages you to request and review the privacy policies of any third parties upon disclosing your personal information to such parties or when visiting such third party websites.

 

Consent

BY SUBMITTING PERSONAL INFORMATION TO SAFETRACKS OR ITS SERVICE PROVIDERS AND AGENTS, YOU AGREE THAT SAFETRACKS MAY COLLECT YOUR PERSONAL INFORMATION AND YOU CONSENT TO THE USE, DISCLOSURE AND TRANSFER OF YOUR PERSONAL INFORMATION IN ACCORDANCE WITH THIS PRIVACY POLICY AND AS PERMITTED OR REQUIRED BY LAW. Subject to legal and contractual requirements, you may refuse or withdraw your consent at any time by contacting SafeTracks at the address provided on the contact us page. If you refuse or withdraw your consent, you acknowledge that SafeTracks may refuse or be unable to provide you with products and/or services or information offered on its website.

 

Collection of Your Information

We may collect personal information from you when you save or otherwise provide your personal information to us, such as by setting up a user account and password, logging in as a registered user of www.safetracksgps.ca, search for a product, place an order for a product, providing information to your account (and you might have more than one, if you've used more than one e-mail address when shopping with us), communicating with us by phone, e-mail, or otherwise or if you complete an entry form to participate, for example, in a contest, promotion, sweepstake or survey.

If you elect to use the services offered by SafeTracks then the physical location of your device will be collected in order to provide you with location-based services. This location data is collected by SafeTracks and/or its partners and used by SafeTracks to provide the services as well as enhance the quality of the services provided by SafeTracks or its content providers.  To provide location-based services, you agree that SafeTracks and its partners and licensees may collect, use and share precise location data, including the real-time geographical location of your device.  Where available, location-based services may use GPS, Bluetooth and your IP address along with Wi-Fi or cell tower locations as well as other technologies to determine your device’s approximate location.

Additional terms and conditions are provided in the License and Service Agreement, the General Terms & Conditions of Sale and the Website Terms of Use that you must agree to in order to receive the location based services offered by SafeTracks.

SafeTracks’ website is directed for use by adults. SafeTracks does not knowingly collect any personal information from children under the age of 18 without first obtaining consent from their parent or guardian.  If you intend to use any SafeTracks product on a minor, you are hereby confirming that you have the authority to provide such consent and hereby provide SafeTracks with consent to collect personal information from your child or guardian.

SafeTracks may use your personal information to: (1) process your order and to answer questions about the status of your order; (2) send you or your friends, relatives or associates, products that you have ordered; (3) maintain contact with you and provide you with ongoing personalized service; (4) communicate with you (via e-mail, post or otherwise) and provide you with promotional materials and additional information regarding our products, services, surveys, contests, promotions and special offers; (5) help us learn more about your shopping preferences; (6) conduct or administer contests and promotions; (7) enforce any policy or agreement on the website and protect SafeTracks against negligence, breach of contract, fraud or other illegal activity; and (8) conduct marketing, marketing research and performance research, to assist us in measuring our customer service, benchmarking our performance and to help us improve the shopping experiences and our product offerings (including without limitation offering new features). As provided below, you may always choose not to receive promotional materials or marketing information.

The personal information that SafeTracks may collect may include your name, username, password, email address, age, date of birth, gender, address, telephone numbers, credit card and debit card numbers (with expiration dates), personal preferences, names of people to whom purchases are to be shipped (including their addresses and telephone numbers), product interest information and any other personal information that you choose to include in your profile, or in other communications to SafeTracks. You represent and warrant that you have the right and authority or have obtained all necessary consents to provide any information, including any personal information of another individual, which is provided by you to SafeTracks. We may also maintain a record of your product interests and acquire information about you from our present and future affiliates or divisions.

SafeTracks may also collect information that may not be personal information, which may include, but is not limited to, the frequency of user visits to the Sites, the routes by which users access the Sites and use of any hyperlinks available on the Sites. SafeTracks or its service providers and agents may process and use this aggregate data for various purposes including, but not limited to, analysis of this data for trends and statistics, development of the Sites and the Sites’ features and offerings, assessing patterns of use, or planning and evaluating marketing initiatives. This information is gathered by certain tools and methods such as the collection of your IP address or the use of cookies and is maintained, used and disclosed in aggregate form unless otherwise noted.

Cookies

Like many websites, SafeTracks may use “cookies” to maintain a record of your visits to the Sites. A cookie is a small text file that is transferred by a web server and stored on the hard drive of your computer. It can only be read by the server that sent it to you. This information does not identify you personally and you remain anonymous unless you have otherwise provided SafeTracks with personal information that will allow us to identify you.

Cookies help us improve the Sites and to deliver more personalized service by enabling SafeTracks to estimate usage patterns and other factors; to store information about your preferences; to speed up your searches and to recognize you when you return to the Sites.

Most web browsers automatically accept cookies. If you would prefer to prevent your computer from accepting SafeTracks cookies, you may follow your Internet browser’s steps for doing so. Please note that if you disable cookies from your browser, it is possible that you will not be able to access certain sections of the Sites.

 

IP Addresses

An IP address is a computer's numeric address, by which it can be located within a network. SafeTracks may record your IP address when you visit or use services or features on the Sites. SafeTracks may use your IP address for the purposes noted above, and also to help diagnose problems with SafeTracks’ server, or to administer the Sites. SafeTracks may also use your IP address to identify you when SafeTracks feels it is necessary to enforce compliance with this Policy or the Terms of Use, or to protect the Sites, systems, information, employees, service providers, business partners, users, customers and others.

 

Protection of Your Information

We strive to maintain the reliability, accuracy, completeness and currency of your information in our databases.  To prevent unauthorized access or disclosure, maintain data accuracy and facilitate the appropriate use of information, SafeTracks (or its 3rd party providers) may use physical, technological and/or administrative procedures to protect the personal information that SafeTracks collects from loss, unauthorised access, modification, disclosure or other misuse. Nevertheless, Internet transmissions are never completely private or secure. You understand that any messages or information you send to the Sites may be read or intercepted by others. At times, SafeTracks may make certain personal information available to strategic partners that work with SafeTracks to provide products and services, or that help SafeTracks market to customers. For example, when you purchase and activate your TRiLOC™ device, you authorize SafeTracks and your carrier to exchange the information you provide during the activation process to carry out service. If you are approved for service, your account will be governed by SafeTracks and your carrier’s respective privacy policies. Personal information will only be shared by SafeTracks to provide or improve our products, services and advertising; it will not be shared with third parties for their marketing purposes.

Your information is kept on our servers or the servers of our third party service provider (“Provider”).  We or our Provider will use industry standard measures to prevent unauthorized disclosure, illegal use or loss of your information.  Consequently, we cannot be held responsible in case such situations occur.

Voluntary Sharing

You might have an opportunity to allow third parties to view the location of the device. If you choose to allow others access to such information, or provide them with your user name & passwords, then you should use caution when determining to whom you want to make such location information available. If you choose to post an invitation to view your location information on third party social networks, then, depending on the privacy practices of those social networks, it is possible that persons in addition to those to whom you intended to invite to view your location information could have access to such information. Accordingly, you should use caution when making such an invitation via third party social networks and you should carefully review the privacy practices of such social networks.

 

Security

We take reasonable security measures to help protect against loss, misuse, unauthorized access, and unauthorized disclosure or alteration of the information under our control. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you might have with us has been compromised), please immediately notify us of the problem by contacting us at the address provided below.

 

Disclosure of Your Information

SafeTracks may disclose your personal information to its subsidiaries or affiliates and to third parties whom SafeTracks contracts to provide services on SafeTracks’ behalf, including, but not limited to, support services and website services.  SafeTracks may also disclose in order to deliver promotional materials, contests, sweepstakes and other promotions, and answer customer questions about SafeTracks’ products and services. These subsidiaries, affiliates and third parties may be located in Canada, the US or overseas. SafeTracks will only provide those third parties with the personal information that they need to deliver the services to SafeTracks and/or on SafeTracks’ behalf. You consent to SafeTracks disclosing your personal information to our legal advisors when reasonably required or as otherwise permitted or required by law.

 

Retention of Your Personal information

The personal information that you provide will be retained by SafeTracks in accordance with applicable laws. However, SafeTracks may in the course of its business destroy information it deems to be stale or obsolete and will take reasonable steps to destroy or permanently de-identify personal information it holds if it is no longer needed for SafeTracks business purposes.

 

Choice and Opt-Out Preferences

SafeTracks does not collect your personal information unless you choose to provide it. If, at any time, you prefer not to receive further email communications from SafeTracks (except in connection with information, products or services that you specifically request), you will have the ability to unsubscribe from such communications by means of a link provided in every broadcast e-mail that is sent to you by SafeTracks.

 

Access and Correction

SafeTracks will take reasonable steps to ensure the personal information it holds is accurate, complete and up to date. Upon your written request and provided your identity can be verified, subject to certain exceptions, SafeTracks will inform you of storage and disclosure of your personal information and give you access to that information. Additionally, if you have any questions or enquiries relating to our privacy practices or procedures, or if you believe that the personal information that SafeTracks holds about you is not accurate, complete or up to date you may write to us at the address provided below. If you are able to establish that the information is not accurate, complete or up to date, we will take reasonable steps to correct the information.

 

Governing Law and Assignment

This agreement will be governed by and construed by the laws of the Province of Alberta, Canada and the parties hereby irrevocably submit and attorn to the jurisdiction of the Courts of the district of Red Deer, Province of Alberta.

We may transfer information to an affiliate, a subsidiary, or a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of SafeTracks’ business, assets, or stock, including, without limitation, in connection with any bankruptcy or similar proceeding.  We may also transfer information to local authorities in the event of an emergency or event that SafeTracks, in its reasonable judgement, deems to be of an urgent or emergency nature.
